Vendor / Advertiser & User Agreement
Each person, company, or legal entity that searches, posts, or purchases from EPICeDEALS agrees to comply with all the following terms and conditions when online and using our web site, posted information, or services.
EPICeDEALS is defined as a digital based marketplace that allows registered legal entities to post products, services, or events/activities that are exclusive to those that submit payment for purchases or to participate in advertising. Registered Vendors can post items for sale and consumers can buy an almost unlimited variety of items at varied pricing structures and from specific locations at their discretion. Each sale is determined by the description of the sale, terms of use by EPICeDEALS. This agreement and all negotiations are specifically and directly between the seller and buyer. EPICeDEALS provides a forum for discounted / Free items and those purchasers of said items. The limit of items EPICeDEALS will allow to be advertised or posted for sale is based on common sense, current US laws, code of community & society morality, and the adherence to a strict code of social decency. (People who act within the acceptable norms of society are considered decent people. They uphold social expectations and remain faithful to the morals and values of society. They do not verbally or physically threaten nor create harm to anyone for any reason) Additionally, EPICeDEALS does not have any control over and does not provide any guarantee or the existence, quality, safety or legality of items advertised - in addition to the actual truth or specific accuracy of a registered entities content or their listings; the real ability of registered Vendors to post and / sell products, services, and / or access to activities / events plus the ability of consumers to pay the posted prices for any or all of these items; or that a consumer or registered entity will actually complete a transaction or return said item. EPICeDEALS will not promote illegal products / services or activities of any type – EVER. Illegal as defined by local, state, or Federal enacted law.)
EPICeDEALS exists to promote great values in order to promote businesses and savings for consumers / end users.
Each legal entity that signs this Vendor / Advertiser agreement agrees to the following:
- Provide and deliver each specific product, service, and/or access to the event they post on EPICeDEALS within 15 business days from receipt of order notification from EPICeDEALS If delivery is not complete Vendor must provide a full refund to consumers and copy of said refund to EPICeDEALS within 30 days of purchase.
- Allow EPICeDEALS 5 business days from the confirmation of payment for each sale to transfer sale amount less EPICeDEALS fees & taxes to vendor.
- Provide a separate order confirmation email to purchaser and EPICeDEALS within 24 hours of each order notice from EPICeDEALS. ( emailed to Consumer & Sales@EPICeDEALS.COM )
- Understands and agrees to fill out and return a W-9 form and provide banking information to allow us to ACH funds to your US based financial institution.

If you Post, Search, Share, or Buy you agree that EPICeDEALS is designed / exists to promote a world of savings on Products, Services, Activities, or Events.
By using, searching, posting, registering to win, or purchasing through this web site, you agree to comply with and be legally bound by the terms and conditions of these Terms of Use. ( Laws of The State of Florida / US ) Users and / or Advertisers of any product or services advertised or sold on this web site agree to meet or exceed any legal laws / regulations – in addition to any community moral rules / standards.
No Unauthorized access, distribution, reproduction, copying, retransmission, publication, sale, exploitation or any other form of transfer of any portion of the Site, Application or Services, including but not limited to all content, services, digital products, tools or products of EPICeDEALS, is prohibited. All registered users are responsible for safeguarding your log in and acct information. All users understand that EPICeDEALS does not pre-screen all web site content. However, EPICeDEALS reserves the right to alter any content posted, or delete with or without notice to user or advertiser.
By posting any content, you agree & understand you as a user of this site have all rights, title, to all posted content, including but not limited to any consent, authorization, release, clearance or license from any third party (such as, but not limited to, any release related to rights of privacy or publicity) necessary for you to provide, post, upload, input or submit the posted content, or such posted content is in the public domain, or your use of such posted content constitutes fair use. You further represent and warrant that posting such content does not violate or constitute the infringement of any patent, copyright, trademark, trade secret, right of privacy, right of publicity, moral rights, or other intellectual property right recognized by any applicable jurisdiction of any person or entity, or otherwise constitute the breach of any agreement with any other person or entity.
You also agree not to post any of the following types of content to the Site or Application. No adult content, pornography, explicit sexual images, nude images or images depicting death – dismemberment or harm to humans or animals. No content containing explicit, vulgar, or obscene language. No content promoting hate, abuse or destructive actions as defined by any culture. No content promoting illegal activities including primarily political, religious, psychic, or metaphysical content. No content promoting pirated software or content intending for phishing or spreading malware. No content that is disparaging of any person or entity or content that is in violation of any law or regulation. Additionally any other content that is or could be considered inappropriate, unsuitable or offensive, as defined by EPICeDEALS or used to DOX or SWATTING of any individual or entity. AVM, Inc will aggressively press criminal charges if evidence is obtained of any of those circumstances.
By posting or using content to this web site, or by providing any feedback, suggestions, ideas, and other submissions you are giving EPICeDEALS non-exclusive, royalty-free, perpetual, and worldwide license to use your content in connection with the operation of all Services, including, without limitation, the license rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your content, and/or to incorporate it into a collective work. You also give EPICeDEALS the right to sublicense any or all license rights to others. You further waive any and all moral rights in and to such content in favor of EPICeDEALS. All users agree that this means that EPICeDEALS has the right to use any and all ideas you submit (including ideas about our products, services, publications or advertising campaigns) in any manner that we choose, without any notice or monetary or ownership obligation to any user.
EPICeDEALS hereby grants you the user a limited, non-exclusive, non-transferable, license to access and use the web site services solely for your business / personal use. You shall not attempt or engage in potentially harmful acts that are directed against the Services including, without limitation, any one or more of the following: (a) Using the Services in contravention of any other agreement to which you are a party, including without limitation any employment agreement to which you may be a party; (b) causing, allowing, or assisting any other person to impersonate you; (c) sharing your password or login with any other person; (d) logging onto a server or Account(s) that you are not authorized to access; (e) creating more than one account, forging user names, manipulating identifiers, or otherwise impersonating any other person or misrepresenting your identity or affiliation with any person or entity; (f) emulating or faking usage of the Services; (g) violating or attempting to violate any security features of the Services; (h) using manual or automated software, devices, scripts, robots, or other means or processes to access, “scrape,” “crawl,” or “spider” any pages contained in the Site; (i) introducing viruses, worms, software, Trojan horses, or other similar harmful code into the Services; (j) interfering or attempting to interfere with the use of the Services by any other user, host, or network, including without limitation by means of submitting a virus, overloading, “flooding,” “spamming,” “mail bombing,” “pinging,” or “crashing” the Services; (k) causing, allowing or assisting machines, bots, or automated services to access or use the Services without the express written permission of EPICeDEALS; (l) tampering with the operation, functionality, or the security of the Services; (m) attempting to override or circumvent any security or usage rules embedded into the Services that permit digital materials to be protected; (n) attempting to probe, scan, or test the vulnerability of the Services, or any associated system or network, or breach any security or authentication measures; (o) misusing, tricking, disrupting, or otherwise interfering with the functioning of the Services; (p) harvesting or collecting email addresses or other contact information of other users or clients from the Services by electronic or other means; (q) reverse engineering, decompiling, disassembling, deciphering, or otherwise attempting to derive the source code for any underlying intellectual property used to provide the Services; (r) engaging in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services; (s) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; (u) deep-linking to any portion of this Services without our express written permission; (v) acting illegally or maliciously against the business interests or reputation of EPICeDEALS or the Merchants promoted via the Services; (w) hyperlinking to the Services from any other website without our initial and ongoing consent; (x) using the Services or any of its contents to advertise or solicit, for any other commercial, political or religious purpose, or to compete, directly or indirectly with EPICeDEALS; (y) reselling or repurposing your access to the Services or any purchases made through the Services; or (z) using the Services or any of its resources to solicit other users of the Services, Merchants or other business partners of EPICeDEALS to become users or partners of other online or offline services directly or indirectly competitive or potentially competitive with EPICeDEALS including without limitation, aggregating current or previously offered eDeals or Freebies.
Violations of system or network security may result in civil or criminal liability. You agree that it is your responsibility to install anti-virus software and related protections against viruses, Trojan horses, worms, time bombs, cancel bots, or other computer programming routines or engines that are intended to damage, destroy, disrupt, or otherwise impair a computer’s functionality or operation.
Pursuant to 47 U.S.C. Section 230(d) as amended, AVM, Inc dba EPICeDEALS hereby notifies all users that parental control protections (such as computer hardware, software, or filter services) are commercially available that may assist you in limiting access to material that is harmful to minors. Information identifying current providers of such protection is available on the Internet.
EPICeDEALS makes no representation or warranty as to the accuracy or fitness for use of any offers, including, but not limited to, coupons, rebates, discounts, freebie offers etc. posted via the Services or that any third party will honor or acknowledge any such offers, coupons, rebates, discounts, etc. posted via the Services. EPICeDEALS is not responsible for providing any guaranteed value or delivery for any offers, coupons, rebates, discounts, etc. posted via our web site. EPICeDEALS is not responsible for the change of information at third party sites or stores including but not limited to rebate information, pricing, availability or fitness for use. You understand & agree that EPICeDEALS does not, cannot, and will not review 100% all material made available through websites linked or linking to any part of the Services. EPICeDEALS does not warrant that the Services or any functions contained in this web site content available via the Services will be uninterrupted or error free, that defects will be corrected, or that the Services or the server that makes them available are free of viruses or bugs.
IN NO EVENT SHALL AVM, Inc dba EPICeDEALS OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, Buyers Purchase or A THIRD PARTY’S OFFER(S), REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER EPICeDEALS WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE
AVM, Inc dba EPICeDEALS disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Services. EPICeDEALS reserves the right to modify, suspend, or discontinue the Services or access to the Services of any and / or all users, buyers, vendors / advertisers without any notice at any time and without any liability to AVM, Inc DBA EPICeDEALS. All users agree to pay $20,000 for each (1) Act of using manual or automated software, devices, scripts, robots, or other means or processes to access, “scrape,” “crawl,” or “spider” any pages contained in the Site; (2) Act of introducing viruses, worms, software, Trojan horses, or other similar harmful code into the Services; (3) Act of interfering or attempting to interfere with the use of the Services by any other user, host, or network, including without limitation by means of submitting a virus, overloading, “flooding,” “spamming,” “mail bombing,” “pinging,” or “crashing” the Services; (4) Act of causing, allowing or assisting machines, bots, or automated services to access or use the Services without the express written permission of EPICeDEALS; (5) Act of tampering with the operation, functionality, or the security of the Services; (6) Act of attempting to override or circumvent any security or usage rules embedded into the Services that permit digital materials to be protected; (7) Act of attempting to probe, scan, or test the vulnerability of the Services, or any associated system or network, or breach any security or authentication measures; (8) Act of misusing, tricking, disrupting, or otherwise interfering with the functioning of the Services; (9) Act of harvesting or collecting email addresses or other contact information of other users or clients from the Services by electronic or other means; (10) Act of reverse engineering, decompiling, disassembling, deciphering, or otherwise attempting to derive the source code for any underlying intellectual property used to provide the Services; (11) Act of engaging in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services; (12) Act of forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; (13) Act of deep-linking to any portion of this Services without our express written permission; (14) Act of acting illegally or maliciously against the business interests or reputation of EPICeDEALS or the Merchants promoted via the Services; (15) Act of hyperlinking to the Services from any other website without our initial and ongoing consent; (16) Act of using the Services or any of its contents to advertise or solicit, for any other commercial, political or religious purpose, or to compete, directly or indirectly with EPICeDEALS; (17) Act of reselling or repurposing your access to the Services or any purchases made through the Services; or (18) Act of using the Services or any of its resources to solicit other users of the Services, Merchants or other business partners of EPICeDEALS to become users or partners of other online or offline services directly or indirectly competitive or potentially competitive with EPICeDEALS, including without limitation, aggregating current or previously offered coupons or deals as set forth in Section 2.6 (f)-(z).
Advertising Terms of use
Terms of use of Advertising EPICeDEALS - eDeals / Freebie Ads: All advertisers and / or consumers who search, share, print, purchase, register to win or redeem coupon deals or/ freebie ads that are published / distributed on EPICeDEALS agree to the following terms / conditions: a) All vendors / Advertisers agree to honor the advertisers terms / conditions for no less than 1 calendar month from the date the eDeal or Freebie ad was posted on EPICeDEALS. Also, each Advertiser / Vendor agrees to repost or post new & unlimited EPICeDEALS eDeals & Freebie Ads every 30 days. Each Advertiser / Vendor agrees to post a min of 1ea EPICeDEALS eDeals & 1ea Freebie Ad every 30 days in exchange for “no fee to post or sell” on EPICeDEALS. b) all users hold EPICeDEALS free of any liability with regard to any claim of loss, copyright claims, implied sales results or guarantee of profit from purchasing / using advertising from services on EPICeDEALS. c) all advertisers who post a Freebie Ad understand and agree to offer and provide at least 1ea Free item per 1ea monthly drawing for 1 each product / service / participation in an activity or event and the retail value of the monthly giveaway will be no less the $10 USD – Advertiser understands that EPICeDEALS will collect the names & other information of those that “register to win” each monthly giveaway. ( Advertiser / Vendor will be responsible to perform the random monthly drawing & notify each “Freebie Ad” winner & copy EPICeDEALS on the results of their drawing(s) including: 1) Name of your business 2) name of freebie item being given away 3) date of drawing 4) Name & email of winner 5) Month and year of the Freebie drawing - within 24 hours of the drawing 6) Each Freebie Ad Advertiser / Vendor agrees to send and email winner ( and copy EPICeDEALS @ Freebies@ EPICeDEALS .com ).
Also collect contact information so the advertiser can set up delivery of the giveaway prize to winner each month – also each monthly winner can only win one time per 3 months per each product / service giveaway: d) all eDeal advertisers understand that EPICeDEALS will add an $8 fee to each EPICeDEALS sale plus the cost of the credit card transaction fee and the applicable sales tax and any valid shipping fees to the requested compensate amount per EPICeDEALS eDeal– this adds up to one published price for the consumer to pay per EPICeDEALS purchase. e) After an advertiser is notified by EPICeDEALS of a EPICeDEALS sale, EPICeDEALS will have 5 business days to start an ACH direct pay to the US domestic bank acct that was set up when said advertiser set up in their EPICeDEALS acct when they registered. Provided EPICeDEALS has received full payment for the EPICeDEALS purchased. f) All registered advertisers agree that all financial transactions are final and any rebate, warranty claim, tracking of shipment, or any other customer service function will be the sole responsibility of the advertiser and EPICeDEALS has the right to forward any claim or request for customer service to each advertiser. g) Each Advertiser understands and agrees that any Advertiser who fails to deliver a product or service that was advertised on EPICeDEALS or does not provide customer service that results in the customer stating they are not satisfied with the outcome will have their acct closed ( Per EPICeDEALS’s sole discretion ) and all applicable customers notified that Advertiser has failed to provide satisfactory customer service and / or violated EPICeDEALS terms / conditions or has defrauded consumers. Further, Advertiser understands and agrees to pay all damages incurred result of failing to honor their advertised offers on EPICeDEALS. h) all advertisers understand and agree that in order to increase the chance that consumers will search, share, print, register to win, or purchase any published coupon deal and / or freebie ad, that the advertiser agrees to provide the maximum discount for each coupon deals or freebie ads. EPICeDEALS is not setting your sales prices or the % for discount on your offers – but EPICeDEALS is providing businesses with a no / low cost advertising solution so you can pass the savings on to consumers. Please keep that in mind so we can all help develop more sales through offering maximum discounts / prices.
This User Agreement has terms / conditions that predetermine the way you establish claims you and the way we respond and / or that we have against each other and the way they are resolved . In addition this is an Agreement to Arbitrate, which will require you to forward your claims to an agency of binding and final arbitration. Unless you opt out of these terms / conditions then you / your legal entity will be permitted to request claims against localhost/coupon/actual-site on an individual basis, and not as a participant or class member in any class or representative action or actions, also you agree that you will be permitted to only seek actual & verifiable monetary relief & not imagined punitive damages.
All advertisers who want to post and sell on EPICeDEALS’s digital market place understand and agree to fill out and return a W-9 form & banking information so we can ACH funds to your US based financial institution. , All users agree to all previous listed terms and conditions.
